Business Conditions
These General Terms and Conditions(GTC) govern the relationship between the seller - company MPM Production s.r.o. (hereinafter the "Seller") and customers of MPM Production s.r.o. (hereinafter the “Buyer(s)”). The Buyer is obliged to get acquainted with Warranty Claim Policy and General Terms and Conditions of Sale before ordering any goods from MPM Production.
The Seller
MPM Production s.r.o with its seat in Mezilesi 718, 193 00 Prague 0 – Horni Pocernice, is a company registered at Registration Court in Prague under Section C, insert 38818 as a trading company oriented in the production and sale of toys and plastic kits to distributors and End Users.
The Buyer
End User – at the initial stage of business relationship the End User will hand over to the Seller its contact data necessary for execution of the order, or any additional data the Buyer wants to appear in the bill of sale.
Legal obligations between the Seller and the Buyer not specified in these GTC are governed by the Civil Code Act No. 40/1964 Coll.
Dealer – at the initial stage of business relationship the End User will hand over to the Seller the documents related to legal facts pertaining entrepreneurs (copy of Trade Register Entry, valid Trade Authorisation, VAT registration ). Distributor is obliged to continuously update these data.
Legal obligations between the Seller and the Buyer not specified in these GTC or in any Contract between the Seller and the Buyer are governed by the Commercial Code Act No. 513/1991 Coll.
Individual contract with the Buyer supersedes the General business Terms and Conditions.
The Buyer is aware of the fact that by buying the products offered by the Seller he gets no right to use registered marks, business names, company logos or patents of the Seller or other firms, unless it is agreed otherwise by a special contract.
II. Confidentiality and protection of information
Seller declares that all personal data are confidential and will only be used for the execution of the contract with the Buyer and these data will not be made public or or provided to third parties etc. with the exception of data needed for transportation of the goods or the method of payment concerning the goods ordered (use of name and shipping address)
III. Opening hours
Eshop is working 24 hours a day and full 7 days a week. Except a few hours in month for a regular site maintenance.
IV. Price lists
The on-line shop prices serves as a regular price list. The on-line shop prices are updated periodicaly. The on-line e-shop prices are always valid and up-to-date, except the models that that are announced but in pre-production where the exact prices are not known yet.
V. Pre-production model sales
As a special feature of this on-line shop serves a “pre-sale” of the models that are in state of production and will be available within 3 months. The buyers of these models have these advantages:
- Shop for the pre-calculated prices which can be same or lower then the final prices (but not higher)
- Get a discounted shipping cost if shipped separately from other models that are in stock
- Be the first one who will get the model
VI. Order processing
End-user orders can be placed just by means of on-line shop. Orders and it's validity are processed automatically. If ordered goods are in stock or subjected to “models in production sale” the on-line processing system will let you pay for the order. Otherwise the system will wait until the stock amount of ordered models will be increased.
VII. Withdrawal from the Contract – only for end users
(does not apply for partners and distributors)
If the Buyer can not return the goods in its original condition or their value has been already lowered(the goods were used), the Buyer is obliged to make a financial compensation to the Seller in accordance with the stipulation of § 458 Coll. 1 the Civil Code – in practice it is done by in the form of set-off against the sales price. The sales price is paid back to the Buyer reduced by the respective amount.
The Buyer has the right to withdraw from the contract for following reasons:
The goods were not delivered even after noticing about that fact by sending an email to the address eshop_orders
cmkkits.com and in 1 month after such a notice. The goods which were delivered are not the same as ordered after noticing about that fact by sending an email and even after that a redress wasn't done within 1 month. The goods delivered are damaged and redress wasn't done within 1 month after noticing about such a fact by sending an email to the address eshop_claimcmkkits.com.
If the conditions for withdrawal from the contract are fulfilled, the buyer has the right for full refund. Full refund is done by the same type of payment you used for sending funds to us.

IX. Terms of delivery
X. Warranty
Conditions of warranty on goods are governed by Sellers Warranty Claim Policy and by legal regulations in force in the Czech Republic.
XI. Final provisions
These General Terms and Conditions are effective as of 1.4.2007 and supersede all previous provisions and practices. The Seller reserves the right to change these General Terms and Conditions without previous notice.
